Frequently asked questions

What makes a function ’essential’ under the ADA?
Factors include whether the position exists to perform it, how much time it consumes, the consequences of not requiring it, and whether other employees could absorb it. The template forces you to separate truly essential functions from marginal tasks — the distinction that decides accommodation cases.
Does a job description determine FLSA exempt status?
No — actual duties control, not paper. But a well-drafted description is your best contemporaneous evidence of those duties, and a badly drafted one (’performs clerical tasks as assigned’ for a claimed executive exemption) is the plaintiff’s best evidence.
How often should job descriptions be updated?
Review at every posting, at classification changes, and whenever the real job drifts — typically annually. An accurate description of last year’s job does not defend this year’s classification.
Should we include a salary range?
